Acceptable Use Policy

What this service may and may not be used for. In short: you may not use it to depict a real person without their consent, to impersonate anyone, or to make content that is unlawful where you publish it.
This Acceptable Use Policy forms part of the Terms of Service of Brand Genius AI and applies to everything you upload, generate and publish using the service. The operator's full name and address for service are given at the foot of this page.
What the service is for
The service generates marketing images and captions for a business you own or are authorised to represent. You supply brand materials — a logo, colours, contact details, reference posts, photographs — and a written description of what you want. A model returns an image with a caption.
It is a tool for making your own promotional material. It is not a general-purpose image generator, and it is not intended for producing content about people, organisations or products that are not yours.
People and likenesses
This is the part of this policy we enforce most strictly.
You must not use the service to create content depicting a real, identifiable person unless that person has explicitly consented to that use. When you upload a photograph containing an identifiable person, you are confirming that you hold their consent. A photograph of yourself is enough; a photograph of anybody else is not, unless you have asked them.
You must not create synthetic likenesses, face swaps or “deepfakes” of any person, whether or not they are well known.
You must not depict a public figure, celebrity, politician or other well-known person, and must not suggest that any person endorses you, your business or your products.
You must not create content depicting a minor, and must not upload photographs of children.
Characters saved in the service are fictional brand mascots. You must not build one to resemble a specific real person.
Content you must not create
Content that is unlawful, defamatory, harassing, hateful or discriminatory.
Content that is sexually explicit, or that sexualises a minor in any way.
Content that is deceptive or fraudulent, including false pricing, fake reviews, fake testimonials, and misleading health, medical, financial or investment claims.
Content that infringes somebody else's intellectual property, including their trade marks, characters, artwork or photographs.
Content that impersonates a business or public body, or that falsely suggests an affiliation or endorsement.
Content promoting weapons, illegal drugs or self-harm.
Anything prohibited by the terms of the model providers we rely on, which are named in our Terms of Service.
Automated safety systems
Requests and the content produced from them pass through the safety systems of the artificial intelligence provider that generates them, and a request may be refused before anything is created. Those systems belong to that provider, not to us, and we cannot override them.
A refusal is not an accusation. Requests are sometimes refused for reasons that have nothing to do with intent. Credits taken for a request that fails or is refused are returned to your balance.
Those systems are a backstop, not a substitute for this policy. Content that passes them is not content we have approved.
Before you publish
We do not review what you generate, and generated content is not checked for accuracy or originality. Read every output before you use it.
You are responsible for checking that prices, offers, dates, claims and contact details are correct, and that what you publish complies with advertising and consumer protection law everywhere you publish it.
Some platforms and some countries require you to disclose that content was generated by artificial intelligence. Meeting that requirement is yours.
How we enforce this
We may investigate suspected breaches. We may remove content, suspend or close an account, withhold unused credits in cases of fraud or abuse, and report unlawful material to the authorities.
We act on what we find and on what is reported to us. We do not routinely review content, so a breach going unnoticed is not permission.
Closing an account for breach does not entitle you to a refund of credits already spent. Your statutory cancellation rights are unaffected and are described in our Refund Policy.
Reporting a breach
If you believe content made with this service breaches this policy — in particular if it depicts you, or somebody you are responsible for, without consent — email support@brandgeniusai.app.
Tell us where you saw it and include a link if you have one. We aim to acknowledge within two business days. Reports about a person's likeness are treated as urgent.
Changes to this policy
We may update this policy as the service changes, or as the rules that apply to us change. The date at the top of this page is the date of the current version. Continuing to use the service after a change means you accept the updated policy.
